Lawn Company Property Damage And Alcohol Consumption While Working.
Location: Arizona, USA
Hi. I need advice urgently please.
Situation:
My husband and I purchased a new build the back yard was a complete dirt lot. We decided to get the yard done, we hired a company. Said company called themselves luxury while speaking to us. The plan was: irrigation, large amount of grass, paver boarder, pavers along side of house trashcan pad all the way up to a paver pad next to the patio, paver pad in the grass with paver steps to it, rock everywhere else. We had a shed outback that was originally bought for $923 from Costco 5 years ago, same shed is no longer available at Costco and averages 1700-2200 depending on retailer. Throughout the process $1300 ($500 cleanup fee) was added to the original cost plan for unforseen stuff. During the process our shed was broken (doors ripped off, plastic up top pulled off ect). We found out about the shed at the end, numerous other mistakes were made that we found during the final walk through. At no point were we rude, upset, or chewed anyone out. We asked everything be fixed they said if they couldn't fix the shed they would replace it (it was not fixable). The next day we discovered beer cans in the outside bin, my husband went back through our camera footage and saw one of the guys drinking (it was a mexican beer, he drinks ipas i dont drink beer ever). The owner is offering $1500 back, $1000 for the shed and the $500 misquoted cleanup fee at the beginning (we were told toss them like $50). I am asking for $3,000 the cost to buy a new shed, the 500 for the misrepresented cleanup fee, and the remainder for the burden of having to dispose of the old shed (its an 8ftx8ft) and build the new one (it originally took days to put together its a heavy duty shed with hundreds of screws/bolts). They are trying to say they don't even need to cover the cost of a new shed. I do not feel as though this was a luxury company, they consumed alcohol while working without our knowledge and operated heavy machinery, and damaged our property. We still owe 4k and some change and are refusing to pay until an agreement has been reached. Is what I'm asking possible? Is what hes offering even a legal offer? Any and all insight/advice is very very appreciated.
Edit to add: no personal injury was had at any point.
