Location : Florida Can A Final Divorce Be Changed ? Appealed?

Card image cap

After being married for over 20 years, my husband had an affair and left our family ( children are home, but over 18) to be with his affair partner. Our divorce was finalized last August in Florida.

I earn about 4 times what he does. During the divorce, he agreed not to seek alimony and not to pursue any portion of my 401(k). He said he felt guilty because he was the one who had the affair and left the family, and he didn’t think it was right to ask me for alimony or half of my retirement. He doesn’t have a 401(k) of his own.

Recently, I learned through my ex’s sister that he changed his mind. Apparently, his affair partner is upset that he walked away without getting alimony or part of my 401(k), and now she’s pushing him to go after both.

From the outside, we had what looked like a great life. nice house, nice cars, and great vacations. His affair partner shared that( his words) she wants that life style and didn’t realize that I was the one funding most of that lifestyle because I earned significantly more than he did.

My question is: Since our divorce has already been finalized in Florida, can he come back now and try to get alimony or part of my 401(k) after agreeing not to pursue either during the divorce? Has anyone dealt with something similar?
