Lost My Promotion That Ive Held For 7 Years For Being Disabled
Location: Tennessee
Ive worked for a large, national chain grocery store for 10 years.
I was promoted to department lead 7 years ago.
I also have rapid cycling bipolar 1 and schizophrenia.
I am on a fairly heavy med regiment and stabilized. I have not been hospitalized since 2019.
I have a few accomadations at work
- be kept on a stable schedule (10-6 {the dept is open 11-5} schedule and set days off. except for monthly inventory I will be off the day before and work 6-2 then off the day after)
-have water on my person
- have a fan on my desk
- be allowed to use ear plugs that block out ambient noise as needed (i can still hear if a customer or coworker speaks to me, but it lessens the voices of carts, jacks, ambient chatter, etc. Which can occasionally cause hallucinations or anxiety. They are loop brand earplugs and not capable of playing music)
I was hired in 2017 with all of these accomadations, and promoted in 2019 with them. My numbers speak for themselves, and for our most recent holiday I was #1 for dollar amount of sales and #3 for percentage over predicted sales.
I went through recertification with district HR and a union representative in december for my accomadations.
We got all new managers in march.
Today i was called into the office by an assistant manager and told they will no longer allow my accomadations because it isnt fair to other employees who have none. When I said it was federal law, she said she wasnt playing favorites here.
I attempted to speak to the store manager about it (I did get this conversation on recording). I was told that its my choice to be disabled and I need to live with it, and that he does not need to follow accomadations because he is the manager.
I have left a voice mail for our union representative and my lawyer. I wrote an email to the hr head that was CC'd to our old hr head (which has handled my accomadations for the past 10 years), the district and division hr team, the union, the dm, and the store manager, detailing what I was told and offering them an opportunity to settle this in house before I proceed with my lawyer. I also CC'D myself and my mother for documents sake.
Can anyone assist me with hoe to move forward with this?
