Minnesota Home Disclosure

I purchased a townhome about 1.5 years ago. The home is built on a slab with a second story, but it has an underground shared garage. Each owner has their own designated garage stall located beneath their unit, and I have interior stairs leading directly from my townhome down into my garage.
Would this underground garage be considered a "basement" for disclosure purposes?
I'm asking because the concrete walls in my garage stall are cracked, and water enters the garage every time it rains. When I purchased the home, the sellers checked "No" on the disclosure form for the section asking whether the basement, crawlspace, or slab had any cracked floors or walls, flooding, foundation problems, leakage, or wet floors/walls. However, the underground garage has all of those issues.
The HOA has confirmed these water intrusion and cracking issues have existed for years, and you can even see the wall cracks in the original listing photos.
I'm hoping to sell the townhome next year, and I'm concerned that I'll be required to disclose these issues even though the previous sellers did not.
One additional note: I did have a home inspection before purchasing, but the inspector never went into the garage.
