My Daughter Purposely Took My Bus Home On Her Dad’s Timesharing Day

Location: Florida

EDIT: She’s 13

Throwaway account for obvious reasons. I apologize in advance that there is so much context. I honestly tried to cut it down as much as possible, but there is a lot.

Context: My daughter has a very strained relationship with her father. He wasn’t in really a stable part of her life until she was 9. Her dad started dating a girl who had 4 kids and it wasn’t a good look that he had almost no contact with his own kid. He would be in her life for a few months, do something extremely dangerous and ask me to keep her away from him. After Covid he pretty much just gave up.

He gained partial custody when she was 10. The current parenting plan is that he has her every other weekend and every Tuesday night during the school year, and 50/50 during breaks on a 2/2/3 schedule. We both get a 7 consecutive day vacation once a year. He scheduled his vacation so he would have her the 7 days before school started, and the three days before that were his regular timesharing days. She was absolutely miserable the entire time. Ten days of being shut inside a room that’s not even hers, full of mildew and mold. There is almost nothing that belongs to her there. I provide all of her personal belongings. He has no clothes or personal care items there that she doesn’t have to bring back and forth. Her dad lives inside a nearly condemned camper on his mom’s property, and my daughter lives inside of the mom’s house where her grandpa committed suicide by gunshot inside. He is either rage baiting her, yelling or degrading her, or ignoring her. They may go and do something (walk around the mall or have lunch out) a few times a year. It’s no wonder why she doesn’t enjoy being there.

She started school yesterday, went to school in his bus and came home on mine. Since today is Tuesday she was supposed to take his bus to his house for his regular timesharing. She asked me about it this morning and I told her that, yeah, she was supposed to. She said she didn’t want to and was going to try to get out of it.

She called her dad and he said “absolutely not” and yelled at her and threatened her that he was going to have me “arrested” and the whole nine. He yells at her pretty much daily. He then texted me telling me that he is going to “take me to court for alienation” and if she didn’t come home he would be calling the police. (The alienation on my part is in his head. I try not to talk about him. He makes her dislike him on her own. There has never been and will never be any proof of this, so I’m not worried about contempt) I sent him a screenshot of where I told her that she was supposed to go to her dad’s house after he texted me about what happened.

Ok, here where I need legal clarification. I know family law issues are civil matters and the police can’t really do much. If he were to actually show up to my house, what would actually happen? My husband is home, so I’m not really scared of being in danger or anything. If her father shows up, he’s going to have to get off my property. What do you think the cops would actually do? And would I have any legal ramifications?
