My Ex Raped Me While Unconscious Years Ago, Can I Still Do Anything?

About 8 years ago when I was months into a new relationship, I found a video saved on my ex's computer that was him having sex with me while I was unconscious from drinking; I was even snoring. I had no memory of it and when I found it on his computer I was hysterical. I screamed and cried and told him to leave me alone in the room, I felt so violated and he just gaslighted me and started acting like he should break up with me for being so dramatic. He was aware I had been raped before many years prior and how big of a deal this was to me.

Despite this and almost breaking up, I stayed with him. It was the beginning of a very emotionally abusive relationship that I stayed in for 3 years. At the time it happened I told my 2 closest friends who were horrified and urged me to leave, but like I said he totally was gaslighting me and I stupidly fell for it. We worked together at the same company and he was telling other mutual coworkers that I was this crazy person, work got so bad for me at the time.

All of this and even more was documented through texts and I am still in contact with people who know/knew about it at the time.

We have been broken up for about 5 years and I was a shell of a person. My mental health was shit and is better but still, I have nightmares about it to this day. At the end of our relationship he started to casually joke that he was having sex with me when I was sleeping and I would get so upset and ask if he is being serious? He would just laugh at me, ignore me for days.

I realize all of that stuff is just context but my question is, with video and text history, would I have a case to report him raping me when I was black out drunk?
