My Father, Who Is 62 Was Out Riding His Bike And A Tree Fell On Him.
LOCATION: California
Hello, thank you for anyone who took time to read this, here is the backstory;
My father, who is 62 was out riding his bike on a public paved city bike trail when a tree in the city owned property lost a large portion (I guess you’d call it a branch but it was a very large several hundred pound piece). This branch fell and hit him in the back of the head, causing him to lose consciousness. There is a record of a 911 call on his phone, but the information that came from it hasn’t been released. He was found by local kids after an unknown amount of time bleeding from multiple points on his head and completely unresponsive. They again called 911 and gave a location, less than a mile from the nearest fire department. The ambulance took over 19 minutes to arrive and took him to the hospital. By the time he arrived he could not remember his name or the year, and was taken in for trauma scans. It has been 2 weeks since the incident and they have released him from the ICU, with an inability to walk, constant double vision and at his age pretty much unrecoverable injuries.
I am writing this post to see if anyone knows anything about holding the city accountable as I feel the neglect of city property, as the park tbh at was open was clearly unsafe (average wind speed from my best understanding of the timeframe was <3mph) and still trees are falling. On top of that it was just released today the abysmal response time for paramedics, which spurred me to action. I have done some reading and know in California we only have 6 months to file for any type of claim/suit when the city is involved so I know I need to either do it now or do it never.
