My Landlord Put Photos Of The Inside Of My Occupied Apartment On Zillow, Including My Belongings. I Was Never Told Anyone Was Coming In.
Location: Oregon
I rent one unit in a small fourplex. My lease runs through next spring.
Yesterday a coworker sent me a Zillow listing and asked if I was moving. The entire building is apparently for sale.
When I opened the listing, there were about 25 photos of my apartment.
These are not old photos from before I moved in. My couch, family photos, computer setup, medication organizer on the kitchen counter, bedroom, closets and even the contents of an open bathroom cabinet are clearly visible. One photo shows a piece of mail on my desk where my full name can be read if you zoom in.
I had absolutely no idea anyone had entered.
I checked my texts, email, voicemail and the tenant portal. There was no notice of entry that I can find. I work outside the home, so this apparently happened while I was at work.
I contacted the landlord asking when the photos were taken and why I wasn't notified. He responded that the realtor was "authorized to access all units for marketing purposes" and that because the property is being sold, photography is part of the process. He did not answer my question about notice.
I asked for the interior photos of my unit to be removed from the public listing. He said he would "ask the realtor what can be done" but also said buyers need to see the condition of the units.
I understand that a landlord may need to show a property that is being sold. What I don't understand is whether that means someone can enter an occupied apartment without telling the tenant and publish detailed photographs of everything inside.
I've now taken screenshots of the whole listing and saved my messages with the landlord.
Is the lack of notice itself something I can take action over in Oregon? Separately, do I have any right to demand that photos showing my personal belongings and identifying information be taken off the public listing?
I'm not trying to interfere with the sale. I just would have liked the chance to put away medication, mail and personal photographs before the inside of my home was uploaded to the internet.
