My Son Is Being Charged With Battery
Location: Florida
I found out this morning that my son (10) kissed another boy of the same age in his class on cheek yesterday. This morning I get call from the school, he has been suspended for 3 days and is going to switch class rooms with a safety plan in place so the boys don’t come into contact. Later I was informed that the other boys parents are pressing charges. What steps should I take now to help Protect my child and how might this affect him longer term.
Update:
So the school resource officer just spoke with my wife and told her it would be a citation rather than a charge if we sign a form and accept it. We were told that it will go to the prosecutor’s office for review if we don’t sign the form. She implied it is possible it would be dismissed but still encouraged we sign the form acknowledging and accepting the citation. What do we do?
2nd update:
Got some more information. The principal is claiming to be a witness to the incident. I spoke with a local lawyer and they recommended that we sign the form, called a delinquency citation. He said that with the principal as a witness and any statements my son made before we were contacted, if prosecutors did pursue for any reason we would be dead in the water. The delinquency citation removes it as a criminal offense and it is the best way to 100% ensure that it doesn’t go that way.
Thank you to everyone who gave advice and input. It’s a scary situation and it was reassuring to get the advice and perspectives of others.
