Hello

This is regarding an issue in the past

I had a very not so good mother

She had a life insurance policy and it was paid out to her 3 kids (including me) in equal amounts

At the time my mother was on her death bed

I was going no contact with her (for many reasons but they are not important to this story exactly)

At the time i kept getting nonstop calls from everyone in my family trying to get me to reach out and visit

I chose not to (again for personal reasons)

After she passed in order for the life insurance policy to cover the funeral and such i was told i needed to sign and mail a copy of some document back daying i approve of the insurance company using the funds to cover the funeral cost and such

Now before i was notified of this one of my siblings reached out and told me that they need my address to give the company so they can send paperwork

I chose not to give them my address bc i did not want family members showing up

The insurance found my address on their own and sent my the docunentation

However before the insurance company sent me anything to sign and while my sibling was reaching out they told me that i need to agree to let the insurance cover the cist of the funeral and that i have to give a majority of the portion i recieve over to someone else (bc thats what my mother said) and when i asked how much its going to be

They said after the funeral cost and stuff i would probably recueve maybe 2000usd or more

And under those pretences i had agreed bc its only 2k and i figured that wasnt worth having them to keep contacting me

I then asked if anyone was there when my mother told them(my sibling) that

(even a nurse wouldve been good enough as it is someone without family ties)

they said no and i asked did they have any proof my mother said that and my sibling said they have a piece of paper and it was just a piece of notebook paper where my sibling wrote down their own name, my name, and my other siblings name with percentages next to it written in gel pen which i did not think was legitamite and there was no sigature on it or anything

It was written only in my siblings handwriting in light purple gel pen with random number percentages

Example

Sibling 1 - 39%

Sibling 2 - 47%

Sibling 3 (me) 14%

Afterwards about a week later when the insurance company sent me paperwork and everything was finalized and funeral coat were paid for by the insurance company i ended up recieving a little under 100 thousand dollars

When they called me asking for information and walking me through what i had to sign and who i need to email the document to i asked them if im required to give any of this money to other people

And the insurance company said no that legally it was mine and mine alone

After the fact my sibling told me i need to give the money bc i agreed to do so

I mentioned that they told me i would only be recieving about 2k from the insurance not 100k they said "i said 2k or more"

(Now to me if someone is explaining something and they say about 2000 maybe more i think 2000-5000 max not 2000-100000)

Which if they had told me beforehand that it would be around 100k then i would not have agreed and if they showed me the paper written in pen and it had a signature on it i wouldve been more ok with it

At first i had given no money but after getting multiple calls and text while i was working i ended up saying that ill give some money but not everything they said to give and they said that is fine because it is something at least

So i sent roughly between 40-45k to them to give it to the person it was supposed to go to

(I wrote a check and dropped it at my siblings house and i wrote the check out to the person i was "supposed to give the money to")

Later on i check and it said that life insurance contracts take place over wills so if someones will said that the money goes to their kids but the insurance policy says it goes to the wife then the wife gets the insurance money even if the will says otherwise and courts usually take side of legally binding life insurance policy

Also the life insurance policy would have allowed my mother to add or remove anyone to the policy that she wanted to however she did not remove me or add the person that she supposedly wanted to recieve a portion of the money at any point

A few years later my sibling started reaching out and telling me i still owe some money from what i agreed to

After all this explanation and given the fact all of this has taken place in the state of texas

I was wondering if agreeing over text can be a legally binding contract in this situation

Or was there not enough information given by my sibling when agreeing

Or does it being a life insurance policy null and void the text agreement
