Nyc Apartment Ceiling Collapse Compensation

Location: Queens NY

My Queens NY rented apartment suffered a ceiling collapse in August. The collapse occurred in the living room while unoccupied so there were no physical injuries but basically all our possessions in the room were destroyed. We were displaced from the apartment from the first week in August until 1 week ago when the repairs were finally completed. We had provided our landlord 3 separate notices of cracks forming before the collapse in August. The first being in February when the landlord came for their yearly inspection, we pointed out cracks in the main bedroom ceiling plaster, the second being in March when cracks were then found in the living room, the landlord was provided numerous photos and videos of those cracks, the third being again in person in late April when the cracks in the living room were again pointed out to the landlord when he was at the unit for another issue. Each time the landlord told us to just monitor the cracks let him know if they were getting worse or if there was ever any water damage. The cracks looked as bad as the first day we showed them to the day of the collapse and there was never any water damage seen. We sent a demand to the landlord and the building Management corporation requesting over $20,000 in compensation for our damage belongings and overall displacement and loss of use of the apartment. The landlord has countered with about $10,000 worth of compensation which is not entirely in cash but also some form of rent credit. He keeps pushing on the fact we did not have renters insurance, which he states would of covered our personal property, however he had 3 sets of real actual notice of cracks forming and failed each time for any sort of remediation of the issues. Is it worth to pursue legally for additional compensation or should I just cut my losses and stress and accept what the landlord is offering so I can move forward and stop stressing about this daily.
