Nyc Illegal Bedroom And Illegal Sublettor - What To Do??
Location: NYC
My roommates and I rented a 5 bed 2 bath brooklyn duplex in mid november. There are 3 bedrooms upstairs with windows and 2 bedrooms downstairs with no windows. At the time I wasnt aware that 2/5 without windows were illegal bedrooms, I was just thinking of cheap rent. I ended up signing with 3 other people (we can call them A, N, J) because we were in a rush and the last roommate (E) was not able to get her documents on time. All 4 of us on the lease signed a sublease with E. Move in day comes around and we quickly realize that E has 2 teenage children that would be living in her room 4/7 days of the week, sometimes more if there are holidays.
E has fully monopolized the upstairs living room since her kids are always in the bedroom, we've had our fair share of talks with her and she just won't see reason on why living with 2 kids is not what we signed up for. As that's happening, rent is constantly late or unpaid with E and J, and management is breathing down our necks about it.
Eventually management learns about the sublet (it wasn't even our goal to hide it, we just thought for time's sake it would be easier to just have her as a sublet initially and move her onto the main lease. Also, the broker who helped us apply is very very familiar with management and the landlord and knew about this sublet when we applied) and starts ordering us to get rid of E and her 2 kids, but E knows her rights and now that she's stayed more than 30 days she cant be "evicted" or moved out.
Now that its almost Feb 1, I have to move out and started looking for a replacement for my room, this is when I realize how hard it is to find a replacement because its 1) illegal and 2) there are so many people living in the apartment altogether so even if rent is cheap, no one wants to take the room.
E also mentioned she'd be open to taking over my room, but management is refusing to take her application to put her on the main lease, they just keep messaging for us to get rid of her. At this point, I want to use the fact that its an illegal room to break the lease and my roommates are kind of okay with finding somewhere else to live.
Has anyone been in a similar situation before? Either with breaking leases for illegal bedrooms or legally kicking out a sublettor.
