Opened Probate And My Sister Is Contesting Will. Any Advice?
Location: michigan.
Hello so last summer I opened up probate on the house I currently reside in and maintain. Goal was to move property into my name and refinance. My parents both past away with my father being the last to go. Before he past he left a will. No trust. In the will it states I am to be given all assets and the entire estate, and my sister given a smaller amount due to a lack of relationship clause. Anyway, my sister has lawyered up and is contesting the will with litigation. Lawyers leaning towards settlement but atp I am highly against it. I have witnesses and facts in my case. I would prefer going to trial due to the fact I believe she doesn’t have a leg to stand on and that I want my story to be heard by a judge or jury. I have a large equity in the mortgage. And that’s what she’s after. My main thing is: I want to try the case although it’s going to be very expensive, like insane. There’s a chance I can win tho. Or I settle. And what? Take out a loan on the house for that? I don’t know what I should do and my lawyer isn’t the most forthcoming. Any advice helps.
Update or clarification; This is my half sister, had no relationship with her growing up, she’s on my dad’s side. My dad past away 5 years ago and I wanted to get the house into my name. My mother bought this house in 2001. And it was in her name up to the point of her passing in 2013. That’s why she wasn’t promised anything in the will. She wanted nothing to do with my father her whole life. There was no sort of abuse. This is a money grab clear and simple.
