Other Driver Identified By License Plate On Dash Cam, Insurer Says “unable To Locate.” Should I Pursue Small Claims?
Location: Dallas, TX
Hi all, looking for guidance on next steps and whether small claims court makes sense.
I was involved in a car accident in August 2025. No injuries, property damage only. The other driver stopped and we exchanged information at the scene. Did not get a police report.
I have clear dash cam footage of the incident, including a clearly readable license plate of the other vehicle.
I attempted to file a claim directly with the other driver’s insurance, but it was denied / closed because they said "more evasive actions" could have been taken
I then filed a claim with my insurer (State Farm). I just had to pay my deductible. They attempted subrogation, but I recently received a letter stating they were “unable to locate the responsible party.”
My questions:
- If the other driver stopped and exchanged information, how common is it for insurers to still be “unable to locate” them?
- If insurance subrogation fails, is Texas Justice Court (small claims) a reasonable next step for recovering property damage / deductible? If not, what next step should I do?
Additional context:
- Accident occurred within Dallas city limits
- Property damage only
- Dash cam footage is cropped and time-stamped
- Goal is to recover my deductible and rental car costs.
I’m trying to figure out if pushing insurance is the better route, or if small claims court is worth the effort, or what I should do next.
