Pharmacy Gave My Medical Records To My Ex And He Is Using Them In Court.

I am currently in a heated custody battle. I reloacted to a different town back in March 2026 to get some space. I have been going to a local independent pharmacy for my prescriptions since then.

Yesterday my attorney received a new court filing from my ex. In the documents he attached a full printout of my medication history from this exact pharmacy. It clearly shows the specific medications I have been prescribed for anxiety and insomnia over the last three months. He is trying to use this to claim I am unfit to care for our child.

I never authorized him to get this information. I never signed any HIPAA releese form. I called the pharamcy this morning to figure out how this happened. The head pharmacist looked into their system and admitted that a technician gave the printout to my ex last week. He apparently walked in, claimed we were still living together, and said he needed the printout for his tax records.

My family lawyer is handling the custody implications, but I want to hold the pharmacy accountable. This is a huge breach of my privacy and it could seriously impact my legal case.

Can I sue the business directly for violating my medical privacy? Should I be reporting them to a specific federal agency or a state board? I need to know the correct legal steps to take against the pharmacy.
