Portfolio Recovery Levied My Bank Account For A Debt That Is Over 12 Or So Years Old. Is That In Any Way Legal?
The debt was originally from a purchase at Kay Jewelers through general electric corp credit I believe. It was removed from my credit after 7 years but a few years later it appeared again and I disputed it and it was removed from my credit reports. Sometime later I starting receiving calls from portfolio recovery every single day for probably the last couple years. I tried blocking them but they would call from different numbers and I just gave up and ignored it. Then 3 days ago they attempted to charge $5,100 to my checking account but I only had like $860 in there so my account was showing -$4k+ dollars until today when the charge changed to $900 something dollars but is still on administrative hold and pending. I was never served any papers if they actually sued me and even if they did, is it not way past the time they have to legally do so? Why would a judge even rule in their favor? Location: Florida, and my checking account is also a joint account I share with my wife and we receive similar pay so half of the money in there comes from her. What should I do?
