Question About Dating A Divorcée With A Child And The Stipulations Of Her Divorce Agreement From The Child's Father.

Location: Massachusetts

I've been dating a woman for about 2 years now, she is raising a child by herself, and she has a shared custody 1 week on/1 week off agreement with her ex. In those two years I have never met the child or been around her when she is with her. So zero interaction or even ever meeting, but when the relationship moves forward, at some point this will have to change.

In the divorce agreement with her ex, when hammering out the shared custody agreement, he added in these parts:

  1. Both parents shall provide the full name and date of birth of any adult who is spending significant time with the child.
  2. The parties agree that neither parent shall introduce the child to a new romantic partner until they have been in a dating relationship for a full six months. The other parent should be provided the full name and date of birth of the new romantic partner one month prior to any planned introduction.

(Underline added by me)

Few quick background things. There is no reason for prior action of the woman I am seeing to warrant this. No arrests, criminal history, drug or alcohol issues. She's always been a responsible and upstanding parent.

I work in corporate security, I've had multiple background checks, including with the state and the federal government, most recent was just a few months ago.

So the question is, how legally sound is this agreement? The reason I am concerned with the whole thing is that the ex-husband has brought up receieving a full background check in detail provided to him of anyone she is dating. He seems a little unstable and controlling from the stories I've heard, I don't feel confortable giving him that level of information. I would have no issue giving him just the results of an official background check, with personal details edited out, but clearly showing my clean history.

Also, the ex has already broken the agreement, he had moved back to his mother's house after the divorce and there have been multiple people coming and going in that time period, and he has never provided any information.

My other question/concern is the exact language used. It says "shall provide", not "must provide" or anything going into more detail about that part. Also, "significant time" is not defined Is that something that can be enforced or is not binding? I would not want to provide information about my other family members to the ex if the child is around my family during holidays or trips or anything like that. It seems like a bizarre burden. Also, the phrase "should be provided" doesn't sound mandorty either.

Apologies for the long post, the long story short is that this agreement doesn't seem normal and isn't coming from a place of concern for the child, but as a means of control and manipulation on the part of the ex. I would like to know how sound it is, legally. Thank you.
