Recorded Without Consent

Location: Delaware

My child, a minor in high school, was notfied by their school's administration that their ex partner(also a minor) recorded them without their consent while they were video chatting and they were doing something sexually explicit. It was just my child in the recording. The ex boyfriend showed at least 7 peers and one of them told a club director, who notified the school administration.

I was called by the principal and informed about what happened. She told me the school would follow the code of conduct relating to the scenario for punishment in regards to the school. She told me a school resource officer would call me and he would deal with the legal side of things. He called me and told me he needed to know if I wanted to press charges. that I needed to speak to my child to see what they wanted me to do. my child was still in school so I texted them to see how they were,if they wanted to come home and if they wanted to take any legal steps. They told me they didn't want to press charges but they wanted their ex to have some sort of punishmsnt. The school resource officer called me again about an hour after he initially called me and told me he needed an answer because he needed to know what his next steps were. I told him my daughter didnt want to press charges but that we may change our minds after being able to talk in person. He simply said he would note that.

It was a span of 2 hours from the initial call from the principal to the 2nd call from the school resource officer asking me if I made my decision.

The following day an incident occurred where another student overheard administration talking about the situation in regards to the after school activities their ex was in and notified my daughter. I went to the school and found out their ex recieved a one day suspension because it was his first offense and the admin would not tell me if the ex would still be able to participate in the after school activities in which my child is also a member of. I asked about pressing charges, and the school resource officer informed me that because I initially told him i did not want to press charges, that their next step as the resource officer was to factory reset the ex's phone so all evidence was erased and that according to his supervisor we could no longer press charges if we wanted to.

I was NOT told before we made our decision before that all evidence would be wiped if we decided to not press charges.

I have never heard of such a thing, is this truly something an officer would do? if we were to decide to, would we really not be able to press charges against this individual?
