Rental Trailer Caused A Dangerous Fire, Small Claims Advice
Hello. Location: Las Vegas, NV.
Last month I rented a flatbed trailer from a legitimate rental company (not a private owner) to purchase a load of hay. The trailer had such bad mechanical issues that it ended up catching on fire. The mechanic who helped me get home is 100% confident this was due to pre-existing issues, and took photos, videos, and saved damaged steel parts as proof.
I am pursuing a small claims case for reimbursement of the bill for the mechanic and clean-up the 2000lbs of burned hay, as well as reimbursement for the lost hay.
My question is if I can also include emotional damages in my case? I have legitimately been having nightmares about the incident for weeks, have been behind on work and had to decline projects I'd otherwise take, and haven't been myself or felt normal since, despite going to therapy about the incident.
To be clear, I was not physically harmed, but only because I was extremely lucky and made some incredible snap-decisions.
I really think the rental company owes me for their negligence nearly costing my life, but I also absolutely need the $4k of expenses reimbursed and can't risk asking for more if it would get the whole case thrown out something.
