Sexual Harassment Case?

Location: NYC

Context: I‘m a secretary and sent a message to my boss late at night telling him I finished a task. He responded and began asking me questions about if I got home OK, basic checking in questions. He then began complaining about his sexual problems with his wife, his marriage, his inability to perform sexually, and began very clearly trying to bait me into sexting/responding emotionally. I didn’t take the bait and instead gave friendly/encouraging responses to his clear baiting (“tell me something that would shock me”= I told a funny store about getting into a fight with my ex at church). I did not take the bait at any point but he clearly was desperately trying to bait me more and more-asking if I was home alone (twice), asking me what happens when I get drunk, asking me to tell him about my needs, etc. He deleted all his messages (on Whatsapp) before I could screenshot.

Here’s what I have:

My side of the conversation (which show that I was answering questions about my mental state and getting home ok late at night and not taking his bait but responding to him mentioning things like “sin” and a two texts implying we would be sending an email about his medical/sexual problems to his doctor and to a therapist )

Texts telling my husband that he was texting me late “freaking out”

Diary drawings quoting what he said and posted timestamped on social media

My husband, therapist, and coworker all being told that he did this the day of/day after (and I have mentioned it to multiple friends)

My husband saw some of the texts

I very clearly remember the texts

I have text evidence that he knows that I recently had a mental health episode and that he was asking about where my kids were and how my mental health was right before he started trying to sext me

We don’t have an HR department (he is the top of the org). How likely is it that I can organize a case, and would he be able to organize some sort of counter-case?
