Sister Wants To Sue My Mom For Locking Our Food Away From Them.

My(24f) 34 year old sister and her 4 kids has been staying with my mother and I for over 2 years now after struggling with keeping a house and almost losing her kids. The only thing my mom asked of my sister was to use her food stamps to buy food for her kids, and to not do drugs. The plan was for her to apply for housing and to stay with us for the waitlist period, but though various excuses she has not.

My mom and I were recently cleaning her room while she was away, and we found a box with items used for drugs and bits and pieces of those drugs. That alongside the fact that my sister hasn't been buying food, and the fact our mortgage and bills went up and my sister refuses to give my mom any money to help, my mom filed for an eviction notice, which we'll have the court date for on the 30th. My sister found out and is not happy. She's getting a lawyer and threatening to sue my mom because the eviction will be putting the kids in danger. During the eviction, my mom put a lock on our fridge as my sister refuses to buy food, and we need the food in the fridge to feed my younger brother(13) and ourselves. My brother, my mom, and I are the only ones that have a key. My sister is also using this against us and states that we will get in trouble for this. Not only because we're blocking the food from her kids, but because my mom filed for an eviction notice she is technically a "landlord" to my sister in this moment. She states that it is illegal for landlords to lock the fridge from their tenants. She sent texts to my mom and I showing these laws.

I'm nervous my mom and I will get in trouble for this, but we just want her out of the house and we want to be able to eat the food we payed for, especially since we're both struggling with the raised bills and mortgage. My mom said she will unlock the fridge if my sister buys food for the kids, but my sister has not mentioned going food shopping yet, or has brought any food home from her job (she works at a grocery store) Despite her food stamps reloading this week. Should we be concerned about this law? Are we going to get in trouble for child neglect just for blocking the food we bought from them? I'm very anxious for the court date.

Landlord/Tenant tag as this involves an eviction, I'll change the tag if need be. I'm also sorry if this is confusing and will answer more questions if need be. It's just me and my mom figuring this out and are very clueless about this all.

[Edit] Extra iformation I dropped in the comments:

  • We gave her a notice first. It was legally only a 3 day, but we gave her about a week or 2 to prepare before we filed for the eviction.
  • Mom still cooks meals for the kids. The last time my mom cooked dinner, my sister told the kids not to eat it and ordered her own food for them.
