Snow Plow Destroyed My Mailbox. Plow Company Saying Not Liable.
Location: Delaware
Durning the last snow storm, a private owned plow company that is contracted by our Civic Association to clear our county maintained roadways, completely destroyed our mailbox.
After over a week of dodging my calls, I was able to get ahold of them. They stated my mailbox was of poor construction and the plow itself did not hit the mailbox, rather the snow being ejected off the plow is what destroyed it, therefore they are not liable and I’m SOL.
My mailbox was built according to manufacturer recommendations. I contacted our DOT and USPS and they both confirmed the mailbox material and installation is appropriate for our region and follows all their regulations.
Their argument of the plow not hitting the mailbox rather the snow being ejected is where I’m questioning it. I have no proof of the mailbox being directly hit or not but the 4x4 post was completely ripped in half.
Is their argument valid and I’m just SOL or are they just avoiding liability?
