Texas Real Estate Undisclosed Short Sale
Location: Houston, Texas
In March 2026 I went under contract to purchase a home in the Houston area. I paid for appraisal and inspection, $~1600 combined. Two weeks later sellers agents notified my agent the home needs to be a short sale and needs lien-holder approval. By law this needs to be disclosed prior to going under contract. $30K difference in what is owed and agreed sale. Short sale contract was executed and expired to get it approved. I terminated the sale and received earnest money back. Didn’t want to be in a holding pattern with the seller’s bank for an unknown amount of time.
I filed a complaint against sellers agent with the Texas Real Estate Commission who started an investigation. Thinking about suing sellers agent in small claims court to be paid back $1600 I spent on appraisal and inspection if the commission holds sellers agent at fault. Sellers Disclosure Notice was not accurate. Nothing in it to indicate sellers can’t sell the house. If I decide to sue should I sue sellers agent, sellers, or both?
