My late uncle had a lifelong intellectual disability. An earlier will left his estate to my sibling and me. I gave it to the family attorney to correct misspelled names, but it was never returned.

In 2018, the attorney prepared a new will disinheriting us. It placed the remaining estate in a charitable trust and gave the attorney, as trustee, discretion to select the charities. He was also named executor and funeral representative.
The same** **day, the attorney prepared a deed involving my uncle’s home. The property was transferred in 2019 for substantially less than its later resale value. We were told the money paid for nursing-home care, but we have seen no sale records, bills, or accounting.

My uncle died in 2019. The attorney held a leadership position with a charity that expanded around that time. We do not know whether it received estate funds.
Although the attorney knew how to reach us, we received no notice of the new will, death, or probate. We discovered the death ourselves months later. The attorney sent us the family photographs but no will, inventory, accounting, trust records, or distribution records.

Public records now show five figures in unclaimed bank property. We also believe accounts, bonds, or investments had been established for my uncle’s support and that he lived from the interest. Another family estate had transferred money to him, and there may also have been an IRA and shares. None of these assets has been accounted for to us.

Do we have standing to obtain the complete estate and trust accountings, property records, financial records, charitable distributions, and information about the attorney’s relationships with the selected charities? Is it too late to investigate? Can the unclaimed property be recovered without overturning the will? What type of attorney handles this, and are contingency or hybrid fees realistic? Location: NJ
