Update To Iowa Owi About Adderall

So in may of last year I got pulled over for inop 3rd brake light and a hard to read plate that lead to a OWI for my Adderall. Below is a link to the 1st post.

I originally thought it was a scam, but turns out it wasn't. The deputy was just doing his own thing and using a system the department claims they had to knowledge of. The charged me with a OWI for my adderall since my urinal test can back positive at 682 ng/ml with is over the threshold of 500 ng/ml. They claim I said on video that I took more than prescriped which they tried to induce into evidence in the middle of the DOT phone hearing. My lawyer objected, and the judge over ruled it. At least allowing it to be used as a refresher.

However, my wife and I slowed down the video and watched it a few time and found out I never said that. I said the word couple but it was referring to time.

My lawyer pushed off the criminal side for a while, until he suggested I get a public defender, which paid for a toxicologist and reported that my test was within what you would expect for my dosage. And criminal was dismissed.

We found the DOT decision many times and each time they ignore whatever argument we have and give a can response. It basically comes down to 50/50 believable draw goes to LEO. I was an urinalysis coordinator for the Navy so I have experience with this stuff, this was the deputies 10 OWI case.

I am an IL resident and a have a CDL, which I had disqualified and lost my job over.

I need advice with two things,

  1. Can I get a different lawyer to handle to appeal process, or even if I should. My lawyer seems to have lost confidence in this case. And I feel he made bad decisions early which we are working against us.

  2. What are the chances of getting a law suit against the state or department, the based the whole owi stop on my behavior which is typical of ADHD and i was damaged by lawyer fees and lost wages. It may even effect me for years trying to get a new job.

I have no idea what type of case law a lawyer for the law suit should be familiar with. I did email the ACLU, but haven't heard back from them.
