Vehicle Levy's And Costs After Judgement
Location: Santa Clara, CA.
I have a weird corner case that all the lawyers I've called can't seem to figure out.
I have a judgement and the debtor has skipped out on his Debtor Examination. I'm planning to execute a Vehicle Levy as that is the only asset I am aware of.
The Santa Clara Sheriff charges a $2000 deposit (not fee) to execute a vehicle levy. As far as I'm aware, you cannot add a deposit to MC-012 - Costs After Judgement.
However, this creates a catch 22. I have to submit MC-012 before the judgement is satisfied. However, I can't submit MC-012 if I don't know the real costs.
Hypothetically, the debtor can immediately pay the judgement after the sheriff attempts to tow his vehicle. Because I don't know the real costs until after the levy is complete, this could put me out of $2000 because the judgement gets satisfied before I can submit MC-012.
Is there some way out of this that would ensure I can do the levy but not risk the entire deposit?
