Was Issued A Restitution Check From A Criminal Case, Ended Up Being Stolen In The Mail.
I am a victim of crime and was notified mid-late last year that I would be receiving restitution for my case from several years ago. It never arrived within the time frame given (June-August). After contacting the superior court clerk’s accounting services (the check was issued by them) it was confirmed that someone had stolen and deposited the check to their account via a scan from the bank. I went to my local police department and promptly reported the theft and evidence. The clerk staff also notified me that the issuing bank would conduct their own investigation.
It has been a couple of months and I’m wondering if it’s likely at all for me to receive the ordered restitution if it was stolen and, if so, what steps do I need to take? Am I supposed to be contacting the clerk to re-issue a check, the bank, or am I not supposed to do anything? The plaintiff is my state, but the prosecuting attorney that handled my case years ago has since retired so I am not sure what or who to contact for advice.
This whole situation has caused me a lot of distress and I can’t seem to navigate this rationally. I would like to put this all behind me as soon as I can so any help would be appreciated.
