Was Told By My Mother My Father Died , He’s Been Alive This Whole Time
Hi everyone. I’m really struggling and trying to figure out if there’s any way I can see my dad.
About a year ago, my dad was diagnosed with ALS. Around four months ago, my mom told me and my siblings that he had passed away. We believed her and have been grieving him since.
This past weekend, after an argument, she admitted that wasn’t true—my dad is actually still alive and has been in the hospital this entire time.
As soon as I found out, I drove straight to the hospital to see him. When I got there, I was told I’m not allowed to visit because my mom put me on a restricted/no-visitor list.
Since then, things have escalated. She has now filed a temporary restraining order (TRO) against me, and I’ve been told that might affect my ability to appeal the hospital’s decision or get access to see my dad.
My dad is in very poor condition due to ALS, and I don’t know how much time he has left. I’m not trying to cause problems or escalate anything—I just want to see my dad, tell him I love him, and be there for him.
I feel like I lost months I can never get back, and now I might not get the chance at all.
I’m in location: California. I’m trying to understand:
Do I have any legal right to see my dad in this situation?
Can one parent block access like this completely?
Does a TRO automatically prevent me from going through the hospital or requesting visitation?
Are there any emergency legal options that could help me see him while there’s still time?
