What Type Of Lawyer Do I Need?
Location: Phoenix suburbs, AZ
I'm a single member LLC for real estate investing. I had an incident where the neighbor to my first flip property drove into the house, probably intoxicated. They are charged with criminal felony property damage since they hit multiple other things before the house.
The property has an HOA that is responsible for the exterior of the building. So there are going to be three insurance companies involved in this, mine, the driver and the HOA.
I feel like I need a lawyer for a few reasons. 1- I don't trust insurance companies to truly act on my behalf. 2 - Since this is an investment property I am on the hook to hard money lenders which cost me x amount of dollars every day I cannot work on the property and I don't think insurance will care about recouping that loss and that will have to come from the driver if possible. 3- I'm afraid if I use my homeowners insurance I will become uninsurable and therefore out of business.
What type of lawyer do I need in this situation? I know I need someone who understands real estate investing law but also insurance and how to go after the driver but I'm not sure what that all is called. And do I call my insurance company first or the lawyer first?
