Wife Laid Off Days From Due Date
Hello! Long story short my wife’s company sold 75% of the business but is staying open and pursuing R&D on a new product. She notified them 6 months ago of being pregnant and was told by HR verbally (I witnessed) that she would remain an active employee so she could get her maternity leave. Now we are days away from the due date and she was given her notice (Jan 31 final day) and her separation agreement. Every part of me is screaming to bring this to an employment attorney and have her sue the company. We are in NJ as added information. What chance do we have at winning any kind of wrongful termination case or whatever it’s called?

Edit to add it has been told time and time again that layoffs were not happening until June to ease the transition of product to the company that bought it. As of right now, my wife is the only one that is being laid off in January and I firmly believe it is to avoid paying her maternity leave
