Wife Took Our Baby To Another State And Is Keeping The Child From Me.
Location: Nevada.
I need to know if what my wife is done is illegal or not.
Here’s my situation:
My wife and I are still legally married. We have a one-year-old daughter together. I’ve been involved in my daughter’s life since the day she was born. A few months ago, my wife left our relationship, moved to another state, and moved in with another man. I did not consent to her taking our daughter out of state.
Since then, she has blocked me on everything. I haven’t been able to speak to my daughter in almost three months, and I haven’t seen her in almost three months either. Every attempt I’ve made to communicate has been ignored or blocked. I have call logs, messages, and screenshots showing that I’ve been trying to stay involved.
As soon as this happened, I filed my case in my state because I wanted to do everything legally. My hearing is scheduled for August 19. I’ve tried multiple times to have my wife served with the court papers, but service has been difficult, so I’m now working with the sheriff/process server to make sure she’s properly served before the hearing.
I can’t afford a private attorney, so I’ve been representing myself while also trying to find a pro bono family law attorney to help me before court.
I’ve spoken with multiple family law attorneys, and each of them told me they believe what my wife did is unacceptable and that courts generally look very unfavorably on a parent completely cutting the other parent out of a child’s life without a valid reason. Even the sheriff where I need to serve her told me there could potentially be criminal implications, although that’s honestly not what I want. I still love my wife despite everything that’s happened. My goal has never been to get her in trouble—I just want to be back in my daughter’s life.
Another part of this situation is that my wife also walked away from my oldest son, whom she had helped raise since he was about two years old and he is now 11. She still communicates with him, but she refuses to communicate with me at all.
I’m emotionally exhausted. Going almost three months without seeing or talking to my one-year-old daughter has been one of the hardest things I’ve ever experienced. I’m doing everything I can through the Nevada court system, but the process feels painfully slow.
Basically is what she's done illegal? And how can it affect the case going forward?
