Wife Took Out Fraudulent Loan
Location: Upstate New York
My question of legal advice pertains to the actions of the bank in this entire situation. Long story short, my soon to be ex-wife took out a loan using my credentials as a cosigner without my knowledge or permission. As I became aware to the situation, I vehemently denied any prior knowledge of the loan. I’ve been incredibly careful through this entire process, while attempting to help my soon to be ex-wife to not drag her into any type of criminal proceeding. As time has gone on, we plan to sell the house and use the equity to pay the loan. I should restate, she will pay the loan with the equity off the sale of the home, which is in progress currently. The bank has been incredibly pushy and has come to me directly for payment on loan, likely because I had attempted to assist in the situation before, although I’ve become increasingly concerned that the bank did not act in good faith, and I wonder if they can be held liable in any way, as I had not received any phone call, verbal commitment, email, text message, anything of that matter to verify that I wanted to cosign on this loan. Could I seek any type of legal action for damages against this bank in the state of New York without involving any type of criminal charge against my wife?
