Will I Get Penalized For Not Volunteering Visitation?

Card image cap

Location: Florida/Ohio

I have full custody, my ex has supervised visitation (DV and drug issues, he lost custody bc he wasn’t fit). I live in FL, he lives in Ohio.

He’s able to ask for video calls with his child whenever he wants, but since he lost custody a year ago, he hasn’t done a single one. He’s also able to have visitation the first weekend and last weekend of every month. He’s not asked about this a single time. The child is 2, he hasn’t seen his father since he was 3m old, if that matters. My son has, effectively, never met his father.

I have to go to Ohio for a wedding and will be bringing my child. I don’t particularly want to schedule visitation because my child has basically never met him, his father was very abusive to me, his family has made threats of kidnapping my son and assaulting me, and my son is very anxious around strangers. I believe my son would be very upset the entire time, and I wouldn’t be able to be there to comfort him because I’ve got PTSD too bad to be around his father.

If it matters, the wedding and the time we will be in Ohio is not the dates that his father is entitled to supervised visitation.

Will I be penalized for not doing a visitation while in the area anyways? My family says if he were to find out I was in the area and didn’t try for a visit, he could take me to court over it and likely win favor with a judge. Is this true?
