Would I Win In A Small Claims Case

Card image cap

I hired a contractor to replace my roof and told him I needed the new roof to match the old one to comply with my HOA. He said the shingles installed were the same color and that even though it looked off at first, it would fade and match in a couple of years after he had installed majority of the roof.

The color was clearly and completely different and never blended. Because of this, I had to pay 6k out of pocket to redo the roof with a color that actually matched and met HOA expectations.

I’ve already paid most of the original amount with the money from insurance I have withheld the rest of the money insurance gave me. I believe the extra $6,500 was caused by relying on his professional statement that the roof would fade and match.

I have photos, a video from the time of installation (with audio), and receipts. Considering withholding the money and filing small claims.
