Would It Be Worth It To Go After My Stepmother For My Father's Life Insurance When He Legally Was Not Supposed To Switch The Beneficiaries?
Location: Ohio
My sister and I just recently found out from my mother that when their divorce was finalized in 2005 two things she wanted in exchange for no alimony was for her to be able to draw on his pension for the remainder of her life and also that he was to maintain the life insurance policies he had taken out for my sister and I and he was not to change the beneficiary. My father passed away last month, and my mother still had company info so I we called and my name is not listed as beneficiary on the policies, nor is my sister, and they wouldn’t release who was due to HIPAA. My mom thinks I should contact an attorney and see what our options are since it is legally binding and irrevocable, but I really don't want to be seen as this person who just wants money after my father's death. The money would definitely help us out, my mom couldn't remember if it was $50,000 a piece or $75,000. My sister is going through some financial struggles after divorcing her husband during the pandemic, he racked up a lot of debt and there's a lien on her property. I just found out last week that expecting my third child, we've been saving for a down-payment on a larger house prior to this. What type of lawyer would I even look into getting a consultation with?
