Many Americans rely on supplements to help their pets feel and be their best. Under current U.S. law, these products may not have a permanent legal home.

THE LEGAL GRAY ZONE HIDING IN YOUR SUPPLEMENT AISLE

NASC is introducing federal legislation to give animal health supplements the permanent regulatory home they’ve always needed.

Here’s something that might surprise you: many of the animal health supplements your customers count on every day products for joint health, calming, liver support and more don’t have a permanent legal home in the United States. Technically, they exist under “enforcement discretion,” a regulatory gray zone that the FDA has tolerated for decades. But that could change overnight.

The National Animal Supplement Council (NASC) the organization that has spent 25 years setting the quality standard for animal health supplements is taking direct aim at that uncertainty. NASC is seeking introduction of the Animal Health Supplement Act, proposed federal legislation that would establish a permanent, defined legal category for these products. If passed, it would do for animal supplements what existing law does for human dietary supplements: create a clear, lawful regulatory framework that protects the industry, the retailer and, ultimately, the pet.

Why This Matters to You

“Enforcement discretion isn’t a permanent solution,” said Bill Bookout, NASC president and a founding member of the organization. “These products could disappear from store shelves overnight if there is a change in government policy. The Animal Health Supplement Act would remove that threat permanently.”

The legislation would distinguish animal health supplements from drugs based on intended use, establish a product-listing system similar to the one used in Canada, and create clear standards for quality manufacturing, labeling, claims and adverse event reporting. For independent pet retailers, that translates directly to greater confidence in the products you stock and protection from the kind of stop-sale orders that can disrupt a business.

As Bookout puts it, quality is the foundation of customer loyalty. “The consumer will come back, buy it again, tell their friends and increase your business. That’s what NASC has always been about.”

Where Things Stand and How to Stay Informed

NASC has been working with federal legislators and has retained legal and advocacy resources to move the Animal Health Supplement Act forward. The organization plans a coordinated call to action for retailers, pet owners and other stakeholders at the appropriate time urging them to contact their congressional representatives in support of the legislation.

For now, NASC invites all stakeholders to stay current by visiting saveanimalsupplements.org, the dedicated website established to track progress on the Act. Retailers can also join NASC free of charge to access educational resources and understand the rigorous requirements members must fulfill to display the Quality Seal on their products for supplements and, now, for treats as well.
