Title: [FL] Husband had an affair with a direct report at work. Could reporting it to his employer negatively impact me in a divorce?

I'm in Florida and recently discovered that my husband has been having an affair with a female employee who reports directly to him. He is the manager of his location, and the affair involved sexual activity on company property.

We are now facing divorce as a result of his infidelity.

My husband is the primary manager at his location, and I believe his conduct could result in termination if his employer were made aware of the situation, particularly because of the supervisor/subordinate relationship and the fact that sexual activity occurred on company property.

My concern is how reporting this could potentially affect me financially during divorce proceedings.

We both work full-time and earn our own incomes, but his employment and income would obviously be factors in determining the financial outcome of our divorce.

My questions are:

  1. If I report his misconduct to his employer and he is subsequently terminated, could that negatively affect me during divorce proceedings?
  2. Could a judge view my decision to report him as intentionally interfering with his employment or earning capacity?
  3. If he loses his job due to his own misconduct, would the court consider his previous earning capacity when determining financial obligations, rather than his newly unemployed status?
  4. Does the fact that he engaged in an affair with a direct subordinate, including sexual activity on company property, have any legal relevance to divorce proceedings in Florida?
  5. Would it be advisable to wait until after filing for divorce, or until the divorce is finalized, before notifying his employer?

To clarify, I would be reporting truthful information about his conduct, not making false accusations. I'm not looking to retaliate or cause unnecessary harm. I simply want to understand the potential legal and financial consequences of disclosing what happened, particularly when his own actions could jeopardize his employment.

I plan to consult a divorce attorney, but I'd appreciate any insight into how Florida courts might view this situation.
