"if You Die, We'll Help Your Cousin Get Custody Of Your Kids So That She Can Raise Them As Her Own - They'll Tell Them About You When The Kids Are Older" - My Mother
Location: New Mexico/Wisconsin
So I (New Mexico) ended up being told this by my mother (Wisconsin) that she would help my cousin (Wisconsin) gain custody of my and my partner's kids if we died. I'm essentially no contact with this cousin due mostly to age difference but also disputes with her older sister, who played the victim when my sister opened up about being bullied by her for years and when my cousin and her husband took that bullying public, via Facebook. That's a whole different situation, but my cousin is an officer and was barking legal threats at my sister that I handed to the police department she worked at and it cost her a promotion and desk duty for unlawful practice of law. Her husband sat on the village board for that police department; it was brought up and he was asked to resign.
So for obvious reasons, I'm not wanting my kids near this part of the family. I get that New Mexico has grandparents rights and that it's based on access - my partner and I are actually in the prep stages for surrogacy, and this has been on my mind. What options would we have, if any, in directing custody and control of our kids should something happen to us?
