(texas)husband Is In A Domestic Violence Shelter After Attempting Suicide . I’m Terrified Of Losing My Children. What Should I Expect?
I’m in Texas and I’m looking for general legal advice while I wait to hear back from Legal Aid.
My husband and I have four children together. Our relationship has been very unhealthy for a long time. There has been violence from both of us during arguments. I’m not trying to make myself look innocent, and I’m also not trying to make him look like the only person at fault. I’m just trying to be honest.
There were times he assaulted me and I had injuries. There were also times I hit him during arguments, and I take responsibility for that. I’m actively looking for counseling and anger management because I know I need to work on myself.
Recently he had a mental health crisis, after I told him I wanted a divorce and to see other people.. went to the hospital, and has now been discharged to a domestic violence shelter. His mother informed me that he’s there and will be receiving services.
My biggest fear is losing my children. As of now, my children are with me, they’re safe, and no one from CPS has contacted me. I haven’t been served with any custody papers or protective orders. My fear is mostly about what could happen in the future.
I’m already applying for Legal Aid, but while I wait I’d like to understand what I should realistically expect. Does a spouse going to a domestic violence shelter automatically affect custody? What kinds of things should I be doing now to protect my children and prepare if there is a custody case?
I’m looking for practical legal guidance, not judgment. Thank you.
