[tx] Is It Legal For My Landlord To Charge Me $100 Per Every Maintenance Request?
My rental agency recently changed management. This summer, my HVAC stopped working because a part needed to be replaced, and I was charged a $100 maintenance fee even though the issue wasn’t caused by anything I did. I tried reaching out to management to dispute the charge, but my messages were repeatedly ignored. Whenever I spoke with the front desk employee, they simply told me that the fee was stated in my lease.
I understand that I should have read my lease more carefully, and I’ll be more mindful of that with future rentals. However, I’m wondering whether this type of fee is actually legal in Texas, especially when the repair was needed due to an equipment issue that wasn’t my fault.
The section of my lease they referred to is under “Special Provisions” and states: “Tenant is responsible for a $100 deductible for each maintenance request.”
Has anyone dealt with a similar situation or know whether this provision is legally enforceable?
