1099 - Misclassification?
I work as a CFI (certified flight instructor) as a 1099 contractor - under the umbrella of a larger flight school, and my "boss" is always trying to force us to work weekends, wear branded clothing, etc. I understand that isn't totally kosher due to the fact I am not actually his employee... but rather an independent contractor. This hasn't really bothered me too much though, and I understand this is quite common amongst CFI's and flight schools.
Where I have started to run into more of an issue, is due to the fact they are charging students $85 an hour, and I only recive $22 an hour. I have asked for a raise to no avail, even after over 1000 hours of dual given.
I don't understand how they're able to take this much from my hourly fee, when I am really supposed to be setting my own rates? I have never actually signed any contract or anything with this organization, it's all been 'handshake' deals. They also do not allow any instruction outside of their aircraft, unless we also bill it through our school, and therefore get paid our peanut wage. Going from $22 an hour to $85 an hour would be the difference between barley eating, and maybe being able to afford a small boat in the area that I live.. So getting any more money for this would be pretty cool.
Location: Michigan
Can't afford an attorney to talk this over with, and also can not loose this job right now. Any advice would be appreciated.
