Wa - I Was Crashed Into At 80 Mph In My Work Truck, Drivers Insurance Is Claiming New Vehicle Wasn’t Covered.

Hello Reddit, I am posting because today I got news from my car accident attorney for Personal injury protection is dropping my case. They were notified by the drivers insurance that there was a coverage and policy issue at the time of the accident.

I work for a company that works on interstate 5 quite frequently. Our lane was closed while we were doing an operation and a driver who was not paying attention crashed into my work vehicle with me in it, at speeds of 75-80 miles an hour, in our closed lane. It was a 2025 vehicle with paper tags on their vessel.

I am getting payment from L&I those on the job injuries because it was a workplace accident however, during the season I’ve missed a lot of scheduled overtime as asphalt at night in the summertime is where my profession makes its bread and butter.
I’m out a few thousand already I’m just 3 months time.

I’m unsure if I’ll be able to even return to my profession because of my injuries and job requirements. Three months after this accident, I still can’t have any extra weight like a hat or beanie on top of my head without getting headaches and it’s still hard to bend and twist, do even a couple hours of running errands and I feel chronic pain in my lower back attaching to my sciatic nerve.

I want to go about being reimbursed for the overtime that I’m missing at least. I don’t think anything can be done for personal injuries now. I am so angry that somebody who crashed into me has possibly ruined my ability to stay in my profession. And didn’t make sure they had insurance before being an idiot behind the wheel.

And no- The driver who crashed into me did not have a medical emergency at the time of the crash. They simply stated they “didn’t know” we were able to drive so slow on the freeway. All of our traffic management was within the law of alerting drivers the lane was closed. Flashing signs, and lights, arrows. Even “Left Lane Closed, Move Right”

Can I even pursue something so I can break even? If so, how so. I do understand the job I work is dangerous. I’m hoping this is not something I just have to eat, and I’m hoping to return. Right now, it is not looking like I can’t be fully released to my duties again.
