15 Year Old With Iep Brutally Assaulted By 3 Students At School - What Legal Steps Should I Take?

Hello everyone, I’m looking for guidance on what legal steps I should take next after my 15 year old was seriously assaulted at school.

My 15 year old (has an IEP and is borderline spectrum) was attacked today by three fellow students. According to the hospital, he suffered blunt force trauma and serious bodily injuries. The responding officer reviewed video footage and said the attackers landed approximately 35-40 blows directly to his head.

For context, last Friday one of the attackers approached my son at a rec center he goes to after school, gave him a weed vape, and stole his beanie. My son stayed home yesterday because he wasn’t feeling well. Today, when he returned to school, he saw that student and asked for his beanie back. They walked toward the bathroom, and my son says that as soon as he entered, the student and two others attacked him. He doesn’t remember much beyond trying to shield himself.

One of the attackers (17) has already been arrested and charged with class A assault. The officer said another arrest is expected tomorrow, and the third student is a minor who will be handled differently.

I’m trying to understand:

  • What steps I should take right now legally (beyond cooperating with police)?
  • Whether I need to hire an attorney immediately, and what type?
  • What responsibility the school may have, especially given my son’s IEP?
  • Anything I should be doing to protect my son or document what happened.
