A Bit Of A Conundrum.

Card image cap

Location: Louisiana. I was summoned as a witness for a child custody hearing involving my estranged spouse for her other children not with me. The hearing was today. When I was summoned I lived in the state (Louisiana) where the hearing was going to happen. Shortly after my spouse filled for divorce and I lost my job. To make matters worse my spouse has temporary use of my house (actually mine) until the hearing for my divorce 2.5 months from now. I essentially have no income as I just retired from a 20 year military career and have not started receiving pay yet. I moved back to my parents in Oregon (of which I have been a resident the entire time I lived in Louisiana as an Active duty military member).

I explained to my attorney (for my divorce) that I cannot attend because I have no money to pay for travel, lodging, childcare. Nor do I have anyone who can watch my 14 month old daughter in the state of Louisiana. He offered to try to get it on zoom but the attorney whom summoned me did not agree to it. He also refused to pay for my expenses. I did not show up.

The attorney who summoned me is threatening and bullying me saying he is issuing a writ of attachment and the judge is threatening a bench warrant.

I explained to him I live in Oregon and have no income and can't stay at my house.

His response was to to attempt to bully me onto showing up on my own expense. Explaining that I was a resident of Louisiana when the summons was issued. Which completely not true as I have an Oregon Birth Certificate and an Oregon Driver Liscence and have been a resident since birth.

How serious should I take this? I literally have no money to travel there at this time.

I also dont trust my attorney, because I think he threw me under the bus to the judge instead of saying he knew I wasn't going to show and why and that the other attorney would not allow zoom.
