A Few Questions About Reopening Estate.
Location: Kansas
My wife's grandmother passed away in 2021. She was one of four people named in her grandmother's will, which was settled in 2023. The executor of the estate was a local attorney.
During a conversation in 2017, her grandmother told her that she had sold her house and moved to a townhouse. This was where she was living when she passed away, and there was no mention of any real estate in the will.
Friday, my wife received a petition to reopen the estate for conveyance of real estate. In the petition, it states that in 2020 her grandmother signed a letter in front of a notary transferring ownership of the proper to this person, but a deed was never delivered. A date is set in December for the court to decide on reopening the estate.
The house was supposed to have been sold back in 2016 or 2017, and the person who sent the petition is the son of the guy her grandmother sold it to. The original purchaser died in 2019. In checking the county appraiser's site, the property is still in her grandparent's name (her grandfather passed away in 2008).
In all honesty she wants absolutely no ownership of any property and couldn't care less who it goes to.
I have two questions. One, is this something that we need to contact a lawyer (either our own or the original lawyer that was the executor of the estate) about? Two, does she need to appear at the hearing to reopen the estate?
I appreciate any advice.
