Ada Work Concerns
Hey everyone, I'm looking for some advice and trying to figure out if I have grounds for legal action. I am incredibly frustrated, burnt out, and honestly fed up with my workplace.
I work on the teller line at a large retail bank branch. I let HR know back in March that I was getting a wheelchair. At the time, the first HR representative I spoke with was incredibly supportive, promising they would accommodate me, even if it meant doing a custom remodel just for me. Because our branch was already scheduled for a remodel, I wanted to reach out early before any construction plans were set in stone.
Unfortunately, two weeks before my wheelchair arrived in June, that first HR rep abruptly canceled my ticket. They claimed "too much time had passed" and refused to let me file paperwork for temporary accommodations in the meantime, which my doctor would have gladly written.
In July, I re-filed a formal accommodation ticket. It is now October, and I have heard absolutely nothing but weeks of silence. Meanwhile, the branch remodel has already occurred, and they completely left out any accessibility features. In fact, our branch used to have an ADA-accessible teller station, but they removed it during a previous renovation. Now, the counters are 42 inches tall. When you factor in the distance I have to stretch to handle customer transactions, it is physically impossible for me to work from my chair. Because of this, I cannot bring my wheelchair to work on a day-to-day basis. Forcing myself to work without it is severely damaging my health, causing immense physical burnout, and forcing me to exhaust my sick days.
To make matters worse, our branch is completely inaccessible to the public. If a client in a wheelchair comes in, they cannot use the teller line. They either have to bring someone to assist them, stay in the drive through, or sit down with a banker just for a simple transaction. When I brought this up, an HR representative literally told me, "We don't have to accommodate clients," which is stunningly incorrect.
During our last video call in late July/early August, that same HR representative repeatedly tried to pressure and manipulate me into saying I "didn't really need" my wheelchair, or that I could "figure something else out." I had to repeatedly hold my ground and remind her that she was holding a mandatory doctor's note proving it is not optional.
They have had since March to engage in the interactive process. Instead, they gave me empty promises, canceled my tickets, ignored my emails, and actively tried to bully me into waiving my medical needs. This is the only branch in our entire area that isn't accessible, and ironically, I am the one employee who needs it to be.
Do I have a solid case to start litigation here? Any advice on how to proceed with the EEOC or finding a lawyer in Georgia would be greatly appreciated. Thank you.
TL;DR: My employer's HR department has ignored my wheelchair accommodation request since March, canceled my initial tickets, built out a remodel that completely excludes ADA teller access (42-inch counters), and an HR rep explicitly pressured me on a video call to deny my doctor's note and say I "didn't need" my chair. Coworkers are also using slurs like "crippled" with zero HR intervention. Looking for legal advice in Location: GA
