Body Shop Took Insurance Money, Never Repaired Car, Won't Return Calls
My girlfriend got her car severely damaged in an accident that was deemed the fault of the other party. She took the car to a local body shop who took the $8k insurance payout and then never repaired the vehicle. It has now been sitting in the shop for nearly 4 months. They only return calls every several weeks, to say the vehicle will be ready next week. Of course, it never is. We keep visiting the shop only to find the owner never there.
The insurance company, at our repeated urging, has tried calling them multiple times (they never answer of course), and it goes without saying that insurance stopped paying for a rental car after the first 30 days.
This situation is driving us nuts. I wish my girlfriend hadn't given them the insurance money. Paying these people in advance was a HUGE mistake! Are we screwed? Do we have any recourse? Is there any way to put effective pressure on a body shop in this situation?
If they didn't already have the insurance money, I'd demand the car back and have it towed away. But then we'd be out $8k with nothing to show for it. Any advice appreciated!
