Boss “not Having Enough Money” To Pay Me

I’m a 1099 contractor for a small business in Virginia
and I’m paid a percentage of the revenue I bring in. I’m currently owed almost $4k since may and I’m starting to get really concerned about the situation.

For the past 6 weeks the owner has kept telling me I’ll get a check, but then it just doesn’t happen. When I finally pushed him about it, he straight up told me he doesn’t have the money to pay me right now and started explaining how much he pays in rent/overhead every month and that I need to understand how much the rent is when he’s had this business for over 2 years ( I just started there in may)

The thing is, nowhere in my contract does it say I only get paid once the business covers its overhead. There are specific expenses that can be deducted before my percentage is calculated, but general rent/overhead isn’t one of them.
I’m also still actively bringing money into the business. I did over $2k in sales just last week, but I’m still not getting paid what I’m already owed.
I’m a service provider and it’s really difficult to just pick up and leave after you’ve spent months building trust and a clientele. I actually like the job and don’t necessarily want to leave, but this is starting to feel really sketchy. If the business is bringing in money but he doesn’t have enough to pay me, where is the money going? He says there will be a check this week but I’m assuming it’s not going to be all of the amount I’m owed.
Has anyone dealt with something like this as a 1099 contractor? Would you stop working until you were paid? And is the whole “I have to pay rent/overhead first” thing even relevant if that’s not what the contract says?
