Boyfriend Cohabitation Agreement

My (31M) boyfriend (33M) used to live in my boyfriend’s duplex. I bought a house a couple of years ago, and now he lives in my house while he rents out his duplex. We currently split the mortgage and utilities evenly.

My house is definitely a fixer upper. Luckily my boyfriend is incredibly handy. Between the two of us, we’ve been able to get a lot done. However he doesn’t want to invest in the bigger projects because if we breakup, he’ll get nothing (this is where this all stems from). His idea was to set up a Cohabitation Agreement laying out terms of repayment if we were to break up. I agree with the concept that I should repay him for a $10K fence (just an example) he paid to get installed if we were to break up.

What I’m uneasy about is it states that I’d have to reimburse him the part of his mortgage payment that goes to the principal on my mortgage. My seems like it’s overstepping. I’m holding all of the risk. Additionally, I’d like there to be some mention of depreciation of the assets. If we broke up 10 years after that $10K fence was installed, it’s not worth $10K. Thoughts?
