Brother Got In Car Accident, Police Didnt File A Report And Now Insurance Refuses To Cover It

So, a few weeks ago, my brother and his girlfriend as a passenger got in an accident in my car while Im at college. Hes safe and all, but the car is wrecked. For additional context, both are minors.

The incident to my understanding was we was stopping at a yellow light, but a truck hauling a trailer behind him passed him to go through the yellow. When returning to his lane, the trailer hit the front my car and damaged the front such that it drags underneath and is not safe to drive on public roads. They both stopped and handled things properly, and the guy in the truck in the moment claimed he was definitely in the wrong. The truck was a company vehicle, so any claims had to go to the company, not him. He and his company claimed they would make things right as soon as possible. We even have video evidense on a camera from the light they were at.

A few weeks later, today, we hear back from the insurance company. The police department never made a report despite showing up on the scene, and the insurance company, the company at fault, and the driver all now claim that he was not at fault, and now insurance refuses to cover any expenses because of the lack of police report.

So now Im without a vehicle with no vindication over an accident my brother didnt even cause. Clearly some kind of justice has to occur, but Im not a lawyer and I dont even have the money to fix or buy a car, let alone hire an attorney and go through a legal battle while Im at school. I dont know what to do at this point, and not having a mode of transportation kind of ruins any job prospects I could have had for this summer now that my car is ruined without a back up plan. Can we sue the company? Or even the police department for not filing a report?
